Terms of Service

1. Acceptance of Terms

By accessing or using TypeMagic ("the Service"), operated by TypeMagic ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

TypeMagic is an AI-powered writing assistant that helps you polish, summarize, expand, shorten, translate, and otherwise transform text. The Service is available as:

• A web application at typemagic.pro
• A macOS desktop application
• A Chrome browser extension
• A REST API and MCP server for developer integrations

3. Account & Eligibility

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One person or entity may not maintain more than one free account.

4. Subscription & Billing

• Certain features require a paid subscription. Pricing is displayed at the time of purchase.
• Subscriptions are billed on a recurring monthly basis through Stripe.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact support@typemagic.pro for refund requests.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to use the Service to:

• Generate spam, malware, phishing content, or any illegal material.
• Harass, threaten, or impersonate others.
• Attempt to reverse-engineer, scrape, or overload the Service.
• Circumvent rate limits, access controls, or subscription restrictions.
• Submit content that violates any applicable law or third-party rights.
• Use the API in a way that degrades service quality for other users.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

6. Your Content

• You own your content. Text you submit remains yours. We do not claim ownership of your input or output.
• We do not use your content to train AI models.
• We do not sell, share, or monetize your content in any way.
• Your text is transmitted to the configured AI provider (e.g., OpenAI, Anthropic, Google) solely to process your request. Refer to each provider's terms for their data handling policies.
• Saved documents, snippets, and voice profiles are stored in your private Firestore account and are accessible only to you (or your organization members, if applicable).

7. AI-Generated Output

• AI output is provided "as-is" and may contain errors, inaccuracies, or biases.
• You are solely responsible for reviewing, editing, and verifying all AI-generated content before use.
• TypeMagic does not guarantee the accuracy, completeness, or fitness of AI output for any particular purpose.
• Do not rely on AI output for legal, medical, financial, or safety-critical decisions without independent expert review.

8. API & Developer Use

• API keys are personal and must not be shared publicly or embedded in client-side code.
• API usage is subject to rate limits (1,000 requests/day per key by default).
• We reserve the right to revoke API keys that are abused or used in violation of these terms.
• The MCP server is provided for integration with compatible AI tools and is subject to the same terms.

9. Organization Accounts

• Organization owners are responsible for managing members, roles, and shared resources.
• Organization analytics aggregate anonymized usage data from members.
• Shared voice profiles are accessible to all organization members.
• Removing a member revokes their access to organization resources immediately.

10. Intellectual Property

The TypeMagic name, logo, website design, and application code are the intellectual property of TypeMagic and its creator, Christopher Bradford. You may not copy, modify, or redistribute any part of the Service without written permission.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. In summary: we don't store your text on our servers, we don't track you, and we don't sell your data.

12. Third-Party Services

TypeMagic integrates with third-party services including:

• AI Providers (OpenAI, Anthropic, Google, Moonshot) — for text processing
• Firebase / Google Cloud — for authentication, database, and hosting
• Stripe — for payment processing

Each third-party service is governed by its own terms and privacy policy. TypeMagic is not responsible for the practices of third-party providers.

13. Availability & Warranties

• We strive to keep TypeMagic available 24/7 but do not guarantee uninterrupted access.
• The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.
• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYPEMAGIC AND ITS CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM:

• Your use of or inability to use the Service.
• Any errors, inaccuracies, or omissions in AI-generated output.
• Unauthorized access to your account or data.
• Any third-party conduct or content on the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless TypeMagic and its creator from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

16. Termination

• You may delete your account at any time by contacting support@typemagic.pro.
• We may suspend or terminate your account for violation of these terms.
• Upon termination, your right to use the Service ceases immediately. Saved data may be deleted after a reasonable retention period.

17. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

18. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or a notice on the website. Continued use of the Service after changes constitutes acceptance of the updated terms.
